Developer: Marcus Mattier (“Hermes,” “we,” “our,” or “us”)
1. Acceptance of Terms
By downloading, installing, or using the Hermes: AI Daily Brief iOS app (the “App”), you agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy. If you do not agree, do not use the App.
2. Description of the Service
Hermes is a personal productivity app that assembles a spoken “daily brief” from data sources you choose to connect (calendar, Gmail, Microsoft Outlook/Teams, Slack, Apple HealthKit, weather, news, markets, on-device journal, and others). The App may also use artificial intelligence to summarize content, draft email replies for your review, plan meals, and answer questions.
3. AI-Generated Content — Important Disclaimer
The App relies on third-party large language models (currently Anthropic Claude) and on automated data fetches from external services. AI-generated content may be inaccurate, incomplete, out of date, or misleading. Spoken briefs, summaries, draft replies, suggested meals, market readouts, health observations, and assistant responses are provided for informational and convenience purposes only.
- Hermes is not a medical, nutritional, dietary, mental-health, fitness, professional, financial, investment, tax, or legal advisor. Nothing produced by the App constitutes professional advice.
- Do not rely on the App for emergency, time-critical, safety-critical, or financially-material decisions. Verify with the original source or a qualified professional.
- If you have allergies, medical conditions, or dietary restrictions, independently verify any meal suggestions, ingredients, and recipes before consuming them. Although the App attempts to filter against allergens you list, you remain responsible for confirming safety.
- Market data is sourced from third parties (e.g., Yahoo Finance, CoinGecko) and may be delayed, inaccurate, or incomplete. It is not investment advice.
You assume all risk arising from your reliance on AI-generated or third-party-sourced content.
4. Your Account and Connected Integrations
You are responsible for: (a) the accuracy of information you provide; (b) maintaining the security of your device and any third-party accounts you connect; (c) complying with the terms of those third-party services (e.g., Google, Microsoft, Slack); and (d) all activity that occurs through your use of the App. You may not connect accounts you are not authorized to use.
5. Subscriptions, Billing, and Cancellation
Certain features may require a paid subscription. All purchases are processed by Apple via In-App Purchase / StoreKit.
- Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you turn off auto-renewal at least 24 hours before the end of the current period.
- Pricing and term: Pricing, length of billing period, and free-trial details (if any) are shown to you in the App before you subscribe. Prices are charged to your Apple ID.
- Manage or cancel: You can manage or cancel subscriptions in iOS Settings → your Apple ID → Subscriptions. You can also use “Restore Purchases” in the App to restore an existing subscription on a new device.
- Refunds: Refunds, if any, are handled by Apple under Apple’s policies.
6. Acceptable Use
You agree not to: (a) reverse-engineer, decompile, or disassemble the App except as permitted by law; (b) use the App to violate any applicable law or any third-party terms (including Google, Microsoft, Slack, Anthropic, Murf, and Apple terms); (c) attempt to access another user’s data; (d) interfere with or disrupt the App or its supporting infrastructure (including the Cloudflare Worker proxy); (e) use the App to generate, store, or distribute content that is unlawful, harmful, defamatory, infringing, or that violates the rights of others; or (f) use the App in a manner that exceeds the “Limited Use” commitments described in our Privacy Policy with respect to Google user data.
7. Third-Party Services
The App integrates with or sends data to third-party services including, without limitation: Anthropic (Claude API, accessed via our Cloudflare Worker proxy), Cloudflare (request transit), Murf (text-to-speech, if you select a Murf voice), Google (Gmail and user info), Microsoft (Outlook and Teams via Microsoft Graph), Slack, Apple (HealthKit, EventKit, StoreKit, Speech), Open-Meteo, Yahoo Finance, CoinGecko, Wikipedia, BibleGateway, and Google News RSS. We are not responsible for the availability, accuracy, content, terms, or privacy practices of those services. Your use of those services is governed by their own terms and policies.
8. Intellectual Property
The App, including its software, design, and trademarks, is owned by Marcus Mattier and is protected by intellectual-property laws. Subject to your compliance with these Terms, you are granted a personal, non-exclusive, non-transferable, revocable license to install and use the App on iOS devices you own or control, solely for personal, non-commercial use. We reserve all rights not expressly granted.
You retain ownership of content you create (e.g., journal entries, prompts). You grant us a limited license to process that content as necessary to provide the App’s features.
9. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNTS YOU PAID TO APPLE FOR THE APP (INCLUDING IN-APP PURCHASES) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.
11. Termination
You may stop using the App at any time. You may delete in-app data via Settings and uninstall the App. We may suspend or terminate your access to the App (or specific features) if you breach these Terms or use the App in a way that creates risk to us, other users, or third parties. Sections 3, 6, and 8–13 survive termination.
12. Governing Law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the App shall be the state and federal courts located in the State of North Carolina, USA, and you consent to personal jurisdiction there. Nothing in these Terms limits any non-waivable rights you have as a consumer under applicable local law.
13. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms at https://hermesbrief.com/terms.html and update the “Effective Date” above. Your continued use of the App after updated Terms take effect constitutes acceptance.

15. Apple End User License Agreement (EULA) Acknowledgment
You acknowledge that these Terms are between you and the Developer only, not with Apple, and that Apple is not responsible for the App or its content. To the extent these Terms conflict with Apple’s standard EULA for App Store apps, Apple’s standard EULA controls solely with respect to the matters it addresses. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right (and are deemed to have accepted the right) to enforce these Terms against you as third-party beneficiaries.
